Parents win $4m in wrongful death case against Irish nanny

A US judge has awarded $4m (€3.6m) in damages to the parents of tragic Rehma Sabir – who died while in the care of Irish nanny Aisling McCarthy Brady.

Rehma’s parents, Sameer and Nada Sabir, filed a wrongful death suit against Ms McCarthy Brady after a criminal case against the nanny collapsed.

Attorney Martha Coakley said it was not the intention of the Sabirs to enforce the judgment for damages unless Ms McCarthy tried to profit from the sale of her story in “social media, print media, (or) broadcast (media).”

One-year-old Rehma died on January 14, 2103, after suffering injuries in the Sabir family home in Cambridge, Massachusetts.

Ms McCarthy Brady was released from a US jail in August 2015 when the district attorney decided not to prosecute her after a reassessment of the case by the state medical examiner.

She was immediately deported from the US for overstaying her visa.

“I’m happy. We fulfilled our objective,” said Sameer Sabir after getting the judgment.

The Parents of a one year old baby from Massachusetts in the US, who died while a Cavan woman was babysitting her, were awarded $4 million Dollars in a wrongful death civil law suit.

Aisling Brady McCarthy from Lavey in Cavan spent two and a half years in an American prison before the criminal case against her collapsed last year.

Aisling Brady McCarthy stood accused of shaking one year old Rehma Sabir, causing a catastrophic and fatal brain bleed.

The criminal case against her collapsed in August of 2015 after a review by the Medical Examiner.

The parents of Rehma Sabir launched civil proceedings, saying their intention was to prevent Brady McCarthy from participating in and profiting from the production of a book or film.

Middlesex Superior Court Judge Leila Kern awarded $2 million in compensatory damages and €2 million in punitive damages to the Sabir family at the hearing yesterday.

The Judge said she felt strongly that Aisling Brady McCarthy should not profit in any way from the horrendous circumstances.
Brady McCarthy was not represented in Court yesterday – there is no indication she intends to benefit from the sale of her story.
